With a previous experience of 10 years within RTE – The French Transmission System Operator – our partner has a solid expertise as well as a very operational approach of these matters.

AREAS OF INTERVENTION:

Environmental Law:

Issues relating to the environmental assessment of plans (PPRI, PPRN, PPRIF, etc.) and projects, species and protected areas, water, air, climate, ICPE/SEVESO/IOTA, waste, polluted sites and soils, risk prevention, environmental liability…

Energy and Infrastructure Law:

Issues related to the administrative permitting of projects (building permits, environmental authorizations…), real estate contracts (long leases, construction leases, occupation of the public domain…), industrial contracts (EPC, O&M…), connection and access to the public gas and power grids, regulation (CRE calls for tenders, feed-in tariffs and remuneration supplements, self-consumption, storage, …).

ADVICE:

The firm offers legal advisory services to assist in decision-making in the context of projects and/or the determination of strategy, by carrying out complex and technical legal consultations, project audits or administrative authorization applications.

OUT-OF-COURT AND PRE-LITIGATION PHASE:

Our in-depth expertise in Environmental and Energy Law allows the firm to propose amicable settlements to avoid long and risky litigations. We negotiate and settle, in full confidentiality, and our team facilitate transactional protocols accepted and acceptable by all parties.

Our firm also assists you in dealing with the administrative authorities, in the context of your administrative appeals (ex gratia or hierarchical) and your claims for compensation.

LITIGATION:

We assist and defend our Clients before the administrative, civil and commercial courts in the field of Environmental and Energy Law, in their contractual and extra-contractual disputes, as well as before the Dispute Resolution and Sanctions Committee (CoRDiS) of the French Energy Regulation Commission (CRE).

We can also intervene to obtain the appointment of a judicial expert to determine the technical causes, the responsibilities and to quantify the prejudices, or to accompany you in defense within the framework of judicial expertises.

Before the administrative judge, we will be able to assist you in your appeals against refusals of authorizations (building permits, environmental authorizations, etc.), including in summary proceedings, or to intervene in your defense in the event of appeals by third parties against authorizations that you have obtained.

TRAINING :

Our Environmental Law and Energy Law team offers customized training courses, intended for beginners and/or experienced in-house lawyers as well as operational staff (project managers, etc.) who use these subjects in their activities, through LexFormation.
