{"id":41636,"date":"2026-06-16T15:06:35","date_gmt":"2026-06-16T13:06:35","guid":{"rendered":"https:\/\/lexcase.com\/?p=41636"},"modified":"2026-06-16T15:08:23","modified_gmt":"2026-06-16T13:08:23","slug":"41636","status":"publish","type":"post","link":"https:\/\/lexcase.com\/en\/41636\/","title":{"rendered":"I PUBLIC LAW I Ten-year liability: the added value of remedial work reduces the compensation owed to the project owner."},"content":{"rendered":"<p><em><strong>Marseille Administrative Court of Appeal, May 18, 2026, Case No. 24MA03203<\/strong><\/em><\/p>\n<p>When remedial work on a structure affected by ten-year warranty defects brings about a genuine improvement beyond mere repair, the project owner cannot be compensated for the full cost of this work.<\/p>\n<p>In a judgment dated May 18, 2026, the Marseille Administrative Court of Appeal applied this principle and, in passing, reiterated the date on which the apparent nature of the defects is assessed when the contract distinguishes between provisional and final acceptance.<\/p>\n<h2>Background<\/h2>\n<p>An authorized homeowners&#8217; association (ASA) awarded a public works contract to a consortium of companies for the redevelopment of a water intake. After acceptance, defects appeared, justifying a court-ordered expert assessment. With new problems arising, the ASA (Association Syndicale Autoris\u00e9e) brought an action before the court seeking a joint and several judgment against the contractors for damages.<\/p>\n<p>The Marseille Administrative Court ordered the project manager, Tractebel, to compensate the association. Both parties appealed: the ASA sought additional compensation for problems dismissed at first instance, while the project manager contested the judgment, arguing, in particular, that the added value resulting from the remedial work carried out between the submission of the expert report and the occurrence of the new problems should be taken into account.<\/p>\n<p>The question before the court was therefore: when remedial work improves the original structure, must the administrative judge include this added value in the assessment of the damages recoverable under the project manager&#8217;s ten-year liability ?<\/p>\n<h2>The apparent nature of defects is assessed upon final acceptance<\/h2>\n<p>The court begins by specifying the date for assessing the apparent nature of the defects\u2014a crucial point, since the ten-year warranty only covers defects that were not apparent at the time of acceptance, that is, those whose extent and consequences the client could not, at that time, measure.<\/p>\n<p>When the contract stipulates provisional acceptance followed by final acceptance, the court rules that the apparent nature of the defects must be assessed on the date of final acceptance of the work. It is therefore this second acceptance, and not the provisional acceptance, that constitutes the reference point and triggers the warranty. This clarification is not insignificant in practice: it determines the very scope of the defects that may give rise to the ten-year warranty.<\/p>\n<h2>Compensation takes into account the added value of the remedial work<\/h2>\n<p>After establishing the attribution of certain defects to the contractor, the court addresses the assessment of the amount of compensation. The court notes that the remedial work, which was indeed carried out, constituted an improvement to the structure\u2014in other words, an added value.<\/p>\n<p>The solution is consistent with the established principle of compensation: the indemnity must ensure full redress for the damage, without thereby enriching the project owner. Compensating the owner for the full cost of work that provides a structure superior to the one initially ordered would place them in a more advantageous position than if the defects had never occurred.<\/p>\n<p>The court derives its method of valuation from this: it is necessary to determine the cost the project owner would have incurred if the improved solution had been chosen from the outset, and deduct the corresponding added value from the compensation. In this case, as the documents in the file do not allow for quantifying this amount, the court orders a supplementary expert assessment.<\/p>\n<h2>Key takeaways<\/h2>\n<p>The ruling has two practical implications.<\/p>\n<p>For contractors and project managers called upon to provide warranty coverage, the ruling confirms the usefulness of arguing, in their defense, the existence of added value: when remedial work results in a structure of higher quality or more durable than the one initially planned, the compensation they are required to pay must be reduced accordingly. This argument is all the more effective because it concerns the amount of the remedial work and can succeed even when liability is otherwise established.<\/p>\n<p>For project owners, the ruling encourages them to precisely document the scope of the remedial work and its equivalence to the commissioned work: any objectively observed improvement is likely to reduce the compensation.
